Existing agreements: Previously agreed prices, included services and individual written exceptions remain honored. This revision does not automatically change an existing subscription or prior quote. Earlier $25/month hosting agreements retain their promised service scope, including two content updates per month, two-business-day turnaround and the twelve-paid-month content refresh where included.

1. The Services

Smart Cascadia LLC (“Smart Cascadia,” “we,” “us”) offers the following website services under Smart Sites. The person or business receiving a service is “Client.”

• The Build: a custom website for $700 one time, with the project scope agreed before work begins.
• Website Care: optional hosting and care for $59/month for new clients, with no minimum term.
• Starter Pilot: a free personalized one-page website for two businesses total, subject to availability and confirmation of fit and scope. No paid purchase is required.
• Standard Migration: optional setup of a completed site on one compatible destination for $250 one time, subject to a compatibility and scope check.

2. Payment

• The $700 Build fee is due via the provided payment link before final customization and connection to Client’s domain, after Client has reviewed the demonstrated site and agreed the scope.
• Website Care is chosen separately. With Client’s authorization, $59 billing begins at go-live and recurs monthly until canceled. Prior quoted prices and individually agreed billing-start conditions remain honored. The free starter never automatically enrolls Client in care.
• The $250 migration fee is due after compatibility and scope are confirmed and before migration work starts. Third-party fees and separately quoted work require Client’s agreement.
• Standard initial domain registration (around $10), if needed, is included in the $700 Build. Client pays domain renewals. Premium domains and other paid services are agreed separately. The free starter does not include domain purchases or third-party hosting charges.

3. Build and Starter Scope

• The paid Build includes two rounds of copy, image or minor-layout revisions before go-live. Additional rounds are $75 each, agreed before work starts. Previously agreed personal revision exceptions remain honored.
• The free starter uses an established layout for one personalized page: services, About, service area, contact details, Client-supplied photos and a standard enquiry form. It includes one consolidated revision round. Shops, complex booking, custom integrations, elaborate editors and bespoke redesigns are outside the starter scope and require a separate quote.
• Client supplies and approves accurate business information and assets they are entitled to use. We confirm the scope and dependencies before starting and agree a delivery schedule once the required content is available.
• The first pilot is limited to two businesses total across all channels. Requests are subject to availability and fit; further places are not guaranteed. A waitlist or paid Build is available after the first places are filled.
• We use mobile-friendly structure and technical search foundations, but do not guarantee rankings, traffic or leads.

4. Ownership, Website Care and Migration

• Once the paid Build fee is paid, Client owns the completed site’s custom design, code and content. Free starter recipients receive their completed site files and basic handoff instructions at no charge, without purchasing care or migration. Third-party assets, software and services retain their applicable licenses.
• Website Care includes hosting, SSL, backups, technical maintenance and up to 30 minutes of minor content edits each month, with no rollover. Examples include photo swaps, business hours and short text changes. Larger work is quoted separately before work starts.
• We aim to respond to care requests within two business days. This is a response target, not a promise that every request will be completed within two days. We confirm completion timing for the requested work.
• The standard enquiry form is tested at launch and after relevant changes. Care does not include continuous form monitoring, ongoing SEO campaigns, email hosting, redesigns, custom integrations, AI reception or missed-call text-back. Separate services require a separate agreement.
• On cancellation, hosting ends at the end of the paid period. Client may request a full copy of the site files at no charge to arrange alternative hosting. Export does not guarantee that custom backend services, databases, editors or third-party subscriptions work unchanged at another host; we explain those dependencies and any separate work needed.
• Standard Migration includes a suitability check, file transfer/deployment to one compatible host, connection of one domain and HTTPS, checks of mobile layout, navigation, contact links and the agreed standard form, and a short handoff. Existing email DNS records are preserved. Hosting purchases, domain fees, premium licenses, mailbox migration, redesigns, multiple destinations, custom database/editor/storage reconstruction, complex redirects and unusual integrations are excluded and separately quoted.
• The migration fee is optional and never a condition of releasing promised files. Domain connection or launch work already included in a Build, care agreement or earlier promise is not charged again.

5. Domain Name

• Client retains full, sole ownership of their domain name at all times. Smart Cascadia will never request or accept a transfer of Client’s domain into Smart Cascadia’s own registrar account.
• If Client already owns a domain, going live means pointing it at Smart Cascadia’s hosting via a DNS record (an A record or CNAME) inside Client’s own registrar account — typically a short screen-share, a few minutes of work.
• If Client does not yet own a domain, Smart Cascadia can register one on Client’s behalf, but it will be registered in Client’s name with Client as the sole account owner and payer of any registrar renewal fees.

6. No Guarantee of Results

Smart Cascadia does not guarantee any specific amount of website traffic, search engine ranking, lead volume, or revenue as a result of the Services. SEO and marketing outcomes depend on many factors outside Smart Cascadia’s control.

7. Term, Cancellation & Refunds

• Smart Cascadia builds and demonstrates a finished website to Client before any payment is made — Client is shown the actual site, not a proposal, before deciding to buy. Because of this, the $700 Build fee is non-refundable once paid.
• Website Care has no minimum term. Client may cancel by emailing tim@smartcascadia.com at any time; cancellation takes effect at the end of the current paid month, with no partial-month refund.
• The free starter carries no build fee and no automatic subscription. If standard migration is canceled before work begins, its fee is refunded; any different cancellation arrangement must be agreed before work begins.
• Smart Cascadia may decline to continue the Services for any client at its discretion, with a pro-rated refund of any unused, already-paid Hosting period.

8. Assets & Content License

• Client grants Smart Cascadia a limited license to use Client-provided logos, photos, copy, and business information solely to design, build, and operate Client’s website.
• Stock photography sourced by Smart Cascadia (for example, via Pexels) is used under that provider’s applicable free commercial-use license, and remains subject to that provider’s terms.

9. Limitation of Liability

To the maximum extent permitted by law, Smart Cascadia’s total liability arising from the Services is limited to the amount Client has paid Smart Cascadia in the twelve (12) months preceding the claim. Smart Cascadia is not liable for indirect, incidental, or consequential damages, including lost profits or lost business opportunities.

10. Governing Law & Severability

These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law principles. If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.

11. Changes to These Terms

Smart Cascadia may update these Terms from time to time. Material changes will be communicated to active care clients at least 30 days before taking effect. Previously agreed client-specific prices and service commitments are not overridden by this revision; a change to those requires a separate agreement.
