Please read these Terms of Service (“Terms”) carefully before using the website or services provided by SMART CASCADIA LLC (“Smart Cascadia,” “we,” “us,” or “our”). By accessing our website, completing our setup form, or subscribing to our services, you agree to be bound by these Terms.

1. About Smart Cascadia

SMART CASCADIA LLC provides AI-powered phone receptionist services for small businesses, primarily HVAC companies. Our service answers inbound calls 24/7 using an AI voice agent, captures caller information, books appointments, and syncs data to the client’s CRM.

2. AI Voice Technology and Call Recording Disclosure

Smart Cascadia’s service uses artificial intelligence to handle inbound phone calls on behalf of your business. By subscribing and deploying our service, you acknowledge and agree to the following:

Smart Cascadia offers AI receptionist services for small businesses. Services are available via direct subscription or through third-party platforms such as the GoHighLevel Marketplace. Current plans, features, and pricing are described at smartcascadia.com/pricing.html. We reserve the right to modify or discontinue services with reasonable notice to existing customers.

For subscription plans, overage call minutes beyond your included allotment are billed at the rate specified in your plan at the time of purchase. Pricing is subject to change with 30 days’ notice to existing subscribers.

4. Payment Terms

Fees are as described at the time of purchase or in your applicable service agreement. Depending on how you access Smart Cascadia’s services:

We reserve the right to suspend services for direct-subscription accounts more than 7 days past due after written notice.

There is no contract and no cancellation fee. Cancel any time.

To cancel, contact us at tim@smartcascadia.com. Cancellation takes effect at the end of your current billing cycle — you retain access through the period you have paid for. We do not provide prorated refunds for partial billing periods.

We may terminate service immediately if you materially violate these Terms, including misuse of the platform or non-payment following notice. Upon termination, your data will be retained for 30 days and then deleted, unless you request earlier deletion in writing.

By submitting your phone number through our website and opting in to text messages, you expressly consent to receive SMS messages from SMART CASCADIA LLC. These may include appointment confirmations, follow-up messages, service alerts, and notifications. Message and data rates may apply.

Reply STOP to opt out at any time. Reply HELP for assistance, or contact tim@smartcascadia.com. Opting out of SMS will not affect your ability to use other aspects of our services.

Mobile information and SMS consent will not be shared with third parties or affiliates for marketing or promotional purposes. Information shared with subcontractors in direct support of your service request (such as message delivery providers) is permitted only for the purpose of providing that service.

Our services are provided “as is” and “as available.” We make no warranties, express or implied, that our service will be uninterrupted, error-free, or meet your specific requirements. AI-generated responses may occasionally be inaccurate — clients should review call summaries and not rely solely on AI output for critical business decisions.

10. Limitation of Liability

To the fullest extent permitted by law, SMART CASCADIA LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services, including but not limited to lost revenue, missed appointments, compliance penalties, or data loss. Our total liability to any client shall not exceed the amount paid for services in the three months preceding the claim.

Smart Cascadia is a technology vendor. We are not a licensed contractor, dispatcher, or emergency services provider, and are not responsible for the outcome of any calls handled by the AI agent, including missed leads, booking errors, or caller dissatisfaction.

11. Indemnification

You agree to defend, indemnify, and hold harmless SMART CASCADIA LLC and its owners, employees, and agents from and against any claims, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of our services; (b) your violation of these Terms; (c) your violation of any applicable law or regulation, including laws governing AI disclosure, call recording consent, or telecommunications; or (d) any claim by a third party (including your own customers or callers) relating to how you deploy or use our AI receptionist service. This indemnification obligation survives termination of your service.

Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

13. Intellectual Property

All content, scripts, workflows, and system configurations provided by Smart Cascadia remain our property. You may not reverse-engineer, copy, or redistribute our service configuration or proprietary materials without written permission.

14. Governing Law

These Terms are governed by the laws of the State of Wyoming, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of Sheridan County, Wyoming. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

15. Changes to These Terms

We may update these Terms from time to time. We will notify existing subscribers by email at least 30 days before material changes take effect. Continued use of our services after changes are posted constitutes acceptance of the revised Terms. We will update the “Last updated” date at the top of this page when changes are made.

16. Carrier Liability Disclaimer

Mobile carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission by your mobile carrier and is not guaranteed.

17. Age Requirement

By using our services, you confirm that you are at least 18 years of age and have authority to enter into this agreement on behalf of your business.
